The Supreme Court on Monday heard the petition filed by SP leader Azam Khan against the cancellation of his legislative assembly. During this, the Supreme Court summoned the response of the Uttar Pradesh government and the Election Commission of India. The Samajwadi Party leader has been disqualified from membership of the House after he was convicted and sentenced to three years in prison for making provocative speeches.

Hearing the matter, a division bench of Justice DY Chandrachud and Justice Hima Kohli asked Additional Solicitor General Garima Prasad, appearing for Uttar Pradesh, to file his reply on Khan’s plea. The bench also asked Prasad to take his plea to the standing counsel for the Election Commission. The court asked Prasad, “What was the urgency to disqualify him? You should have at least given him some time.” In response, Prasad said the disqualification was in accordance with the apex court’s direction, which it had given in one of its judgments. Senior advocate P Chidambaram, appearing for Khan, said Vikram Saini, a Bharatiya Janata Party (BJP) MLA from Khatauli assembly in Muzaffarnagar district, was also convicted on October 11 and sentenced to two years in jail, but his disqualification . No decision was made.

‘Session judge on leave and high court closed, so come here’

Presenting his arguments, Azam Khan’s lawyer P. Chidambaram said that due to the urgency of this matter, the Election Commission of India will issue a gazette notification on November 10 regarding the announcement of by-elections in the Rampur Sadar seat. He said the Sessions Court judges are on leave for a few days and the Allahabad High Court is closed, so Azam Khan could not go there against his conviction and sentence. The bench asked Prasad, appearing for the state government, why no action was taken on the Khatauli assembly seat issue. The court fixed November 13 for further hearing of the matter and asked Prasad to file his reply after receiving directions.
