Supreme Court’s 5-judge bench gives decision on EWS reservation

EWS reservation: Reservation will continue for poor people on economic basis. The Supreme Court has given its approval to the 10 percent reservation for the poor by 3-2. Justice Maheshwari, Justice Bela M Trivedi and Justice Pardiwala were in favor of reservation while CJI UU Lalit and Justice S Ravindra Bhatt gave their opinion against this reservation. What three judges said in favor of economic reservation

Justice Dinesh Maheshwari first delivered the historic decision on financial reservation. Justice Dinesh Maheshwari said that EWS reservation is not against the basic spirit of the Constitution. The basic structure of the Constitution allows this. Justice Bela M. Trivedi in his judgment said that removal of EWS reservation would be inequity. He said financially strong people also benefit from reservations. Reservation should be reviewed, after review reservation should not be given to skilled persons. Justice JB Pardiwala also questioned the reservation given to powerful people in his decision and said that it is not right to give reservation indefinitely. It is not right to make reservations for those who have been able to.

What were the arguments of two judges against the EWS proviso
After three judges, the fourth judge, Justice S Ravindra Bhatt, delivered his verdict against economic reservation, saying that EWS reservation is against social justice. This is contrary to the basic structure of the constitution. EWS reservation will not end the feeling of discrimination. Finally, Chief Justice UU Lalit also gave his ruling and said that EWS reservation should not be taken. Excluding poor people from SC, ST and OBC shows discrimination.
